Agreement

These Terms of Use constitute a legally binding agreement between you and Gfolio Giftfolio Private Limited (“Gfolio”, “Company”, “we”, “us”, “our”), having its registered office at DS SONS, 6/2011, Lalan Road, Mattancherry, Kochi 682002, Kerala, India.

Definitions

• We, Us, Our, Company – Gfolio Giftfolio Private Limited.
• You, User – Any person accessing or using the Platform.
• Platform – Website, mobile application, APIs, and related services operated by Gfolio.
• Services – Digital gold, digital silver purchase, sale, storage, gifting, transfer, redemption and related services.
• Business Partners – Bullion providers, custodians, financial institutions, payment processors and other service providers.

Eligibility

• You must be 18 years or older and legally capable of entering a binding contract.
• You must provide accurate and truthful information.
• You must comply with all applicable laws.
• You must inform Gfolio if your tax or GST status changes.
• You are responsible for obtaining independent tax advice where required.

Account Registration

You must create an account to use Gfolio services and maintain accurate and updated information. Gfolio may suspend or terminate accounts containing false or incomplete information.

Digital Precious Metals Services

• Gfolio provides a technology platform facilitating digital gold and digital silver transactions.
• Services are provided through authorised bullion partners including Augmont GoldTech Private Limited and E-Swarna (Muthoot Group).
• Partners provide sourcing, vaulting, storage, insurance (where applicable), redemption, and delivery.
• Gfolio acts only as a platform facilitator and is not responsible for partner-provided services.
• Partner terms and conditions apply and prevail for partner services.

KYC Requirements

Users must complete identity verification as required by Gfolio or its partners for regulatory compliance, fraud prevention, storage, redemption, or delivery.

Orders and Transactions

• Prices displayed are indicative and subject to market changes.
• Transactions may require pre-payment and applicable taxes.
• Orders may be delayed, rejected, or cancelled due to technical or regulatory reasons.
• Digital precious metals purchased are stored with authorised custodians on behalf of the user.

Storage and Insurance

Precious metals purchased may be stored in secure vaults maintained by authorised partners. Storage terms and insurance coverage are governed by partner policies.

Pricing and Payment

• Prices are linked to market benchmarks.
• Payment methods may include UPI, cards, net banking and other digital payment modes.
• Users are responsible for all applicable taxes and regulatory reporting obligations.

Delivery and Redemption

• Users may request physical delivery or redemption where available.
• Delivery is fulfilled through authorised logistics partners.
• Users must verify packages before accepting delivery.

Intellectual Property

All intellectual property rights in the Platform belong to Gfolio or its licensors. Users may not copy or distribute content without written permission.

Limitation of Liability

Gfolio is not liable for market losses, partner service failures, system downtime, or indirect damages. Maximum liability shall not exceed fees earned from the transaction giving rise to the claim.

Force Majeure

Gfolio shall not be liable for failure to perform due to events beyond reasonable control including natural disasters, government actions, or technical failures.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Kochi, Kerala shall have exclusive jurisdiction.
